Entre 1920 y 1944, las mujeres guatemaltecas organizadas en torno al derecho al voto concibieron y forjaron lo que posteriormente sería un legado histórico en la línea del feminismo jurídico, en primer lugar, el reconocimiento parcial del sufragio de las mujeres en la Constitución de 1945 que luego se constituyó en universal en 1965. A estas conquistas se sumaron otras acciones impulsadas por colectivos de mujeres para desmantelar, en parte, normativas del derecho patriarcal que históricamente ha sido un pilar de dominación y control de las mujeres y con el paso del tiempo crearon también nuevas leyes en favor de los derechos humanos de las mujeres. Este qué hacer constituye el centro teórico y epistemológico de los feminismos jurídicos considerado para esta investigación. El estudio aporta a la historiografía guatemalteca desde un enfoque teórico y político feminista, y en lo particular a la historia del feminismo jurídico que destaca las contribuciones que colectivos y organizaciones de mujeres guatemaltecas desarrollaron en el campo del derecho en el período 1944-2018. El proceso metodológico de la investigación incluyó un ejercicio de recopilación de reformas y leyes feministas, 42 en total, y un proceso de recuperación de historia sobre las temáticas relacionadas con su desarrollo, incluyendo el reconocimiento de nombres de protagonistas y sus organizaciones. Se realizó investigación documental en archivos especializados y trabajo etnográfico a través de entrevistas testimoniales para documentar las trayectorias políticas de las protagonistas y organizaciones de mujeres que contribuyeron a realizar los cambios en la legislación guatemalteca. |

Between 1920 and 1944, Guatemalan women organized around the right to vote conceived and forged what would later become a historical legacy in the vein of legal feminism. First, the partial recognition of women's suffrage in the 1945 Constitution, which later became universal in 1965. These achievements were accompanied by other actions driven by women's collectives to partially dis-mantle patriarchal legal norms that have historically been a pillar of domination and control over women. Over time, they also created new laws in favor of women's human rights. This "what is to be done" constitutes the theoretical and epistemological center of the legal feminisms considered for this research. This study contributes to Guatemalan historiography from a feminist theoretical and political perspective, and specifically to the history of legal feminism, highlighting the contributions that Guatemalan women's collecti-ves and organizations made in the field of law between 1944 and 2018. The research methodological process included compiling feminist reforms and laws, 42 in total, and a process of historical recovery on the themes related to their development, including the recognition of the names of protagonists and their organizations. Documentary research was conducted in specialized archives and ethnographic work through testimonial interviews to document the political trajectories of the protagonists and women's organizati-ons that contributed to the changes in Guatemalan legislation. |
